Non è sproporzionata o irragionevole e, quindi, non comporta la violazione dell’art. 44, comma 2, della Direttiva n. 2004/18/CEE e dell’art. 42, comma 3, d.lgs. n. 163/2006, la previsione di requisiti di capacità  tecnica assai selettivi nel bando di una procedura finalizzata all’affidamento di un appalto di particolare rilevanza e complessità .

sul ricorso numero di registro generale 1418 del 2011, proposto da Tradeco s.r.l., rappresentata e difesa dall’avv. Giuseppe Mariani, con domicilio eletto presso il suo studio in Bari, via Amendola, 21;

contro
Consorzio ATO Rifiuti Bacino Ba/1, rappresentato e difeso dall’avv. Giuseppe De Candia, con domicilio eletto presso l’avv. Alberto Bagnoli in Bari, via Dante, 25;
Comune di Andria e Comune di Canosa di Puglia, non costituiti;

nei confronti di
Aimeri Ambiente s.r.l., Sangalli Giancarlo & C. s.r.l. e Aprica s.p.a., non costituite;

per l’annullamento
previa sospensione dell’efficacia,
del bando di gara pubblicato sulla G.U.R.I. n. 70 del 15 giugno 2011, per l’affidamento del servizio di raccolta e trasporto dei rifiuti urbani ed assimilati e del servizio di spazzamento delle strade ed altri complementari, da eseguirsi nei Comuni di Andria e Canosa di Puglia, nella parte in cui introduce requisiti minimi di capacità  tecnica ed economica per l’ammissione;
Visti il ricorso e i relativi allegati;
Visto l’atto di costituzione in giudizio del Consorzio ATO Rifiuti Bacino Ba/1;
Vista la domanda di sospensione dell’esecuzione del provvedimento impugnato, presentata in via incidentale dalla parte ricorrente;
Visto l’art. 55 cod. proc. amm.;
Visti tutti gli atti della causa;
Ritenuta la propria giurisdizione e competenza;
Relatore nella camera di consiglio del giorno 21 settembre 2011 il dott. Savio Picone e uditi per le parti i difensori avv.ti Giuseppe Mariani e Giuseppe De Candia;
 

Ritenuto, nei limiti della sommaria cognizione propria della fase cautelare, che il bando di gara, nella parte oggetto di gravame, non appare manifestamente sproporzionato ed irragionevole, tenuto conto della durata e dell’entità  economica dell’appalto, della dimensione dei Comuni destinatari del servizio e, soprattutto, della sicura rilevanza transfrontaliera della procedura, alla quale avrebbero potuto accedere tutte le imprese europee (e quindi non soltanto italiane) titolari di affidamenti presso comunità  ed enti locali di grandi dimensioni;

Il Tribunale Amministrativo Regionale per la Puglia (Sezione Prima) respinge l’istanza cautelare.
Spese compensate.
La presente ordinanza sarà  eseguita dall’Amministrazione ed è depositata presso la segreteria del tribunale che provvederà  a darne comunicazione alle parti.
